This all sounds good, but it sounds complex and potentially unreliable. Also, I think they should target maybe .1 bac rather than .08, which would probably eliminate false positives. From what I find, 2/3 or the alcohol related deaths involve twice the legal bac limit or higher. Not many would involve .1 or lower.
Also, if drunk driving remedies are being pursued, how about distraction? While the reported numbers are not as high as for drunk driving, there are a lot, and they are probably under-reported. I doubt if phone texting records are checked after crashes as frequently as bac measurements of people in crashes.
